These Terms & Conditions ("Terms") govern your use of the Speshul platform, operated by Chhavi Goyal, sole proprietor, trading as Speshul ("Speshul," "we," "us"), as a parent or legal guardian ("you," "Parent") booking services for a child. By creating an account or booking a session, you agree to these Terms.
1. What Speshul Is
Speshul is an online marketplace that helps parents and guardians discover and book independent, third-party special-education Educators, Therapists, Coaches, and Assessors ("Professionals"). Speshul is a platform that facilitates discovery, booking, and payment — it does not itself employ Professionals and does not itself provide educational, therapeutic, coaching, or assessment services.
2. Eligibility
You must be at least 18 years old and the parent or legal guardian of the child for whom you are booking services. You are responsible for the accuracy of the information you provide about your child, including any information relevant to the child's needs.
3. Verified Professional Badge — What It Does and Does Not Mean
A "Verified" badge indicates that Speshul has reviewed the credentials and documents the Professional submitted, as described on the platform at the time of verification. Speshul is not liable to verify the authenticity/ genuinity of any documents shown/produced by the professional with respect to his qualification and filed of expertise. It is not a guarantee, endorsement, or warranty of the Professional's ongoing competence, conduct, or the outcome of any session, and Speshul encourages you to independently evaluate any Professional before booking. Speshul relies on the documents the Professional provides and does not guarantee that they are genuine; see Section 10 for what happens if a Professional misrepresents their credentials.
4. Your Child's Personal Data
Creating your child's profile and booking a session require you to provide personal data about your child, which may include their name, age, schooling, what you have noticed, assessment reports or other session-related information. Before you add your child's details, you will be asked to confirm that you are the child's parent or lawful guardian and to give your consent, as the child's parent or guardian, for Speshul to collect and process this data. Speshul may verify that you are the parent or guardian, for example through an OTP sent to your registered mobile number. Each time you book, you choose which of these details the booked Professional may see, and you can stop a Professional's access at any time. Speshul and the booked Professional will use this data only for the purposes described in our Privacy Policy, in accordance with India's Digital Personal Data Protection Act, 2023 and its Rules. This data will not be used to serve targeted advertising to your child. You may withdraw consent or request deletion of your child's data at any time, subject to information we are legally required to retain, from your profile or by contacting us using the details in Section 14. 5. Booking, Fees, and Payment
Session fees are set by each Professional and shown on their profile before you book. Speshul charges a platform commission which is included in or added to the displayed price as described at checkout. Payments are processed through the payment gateway; by booking, you authorize the applicable charge to your chosen payment method.
Payment hold and release. Your payment is collected when you book and is held by Speshul's payment partner. It is released to the Professional only after the Professional confirms in the app that the session took place. If you tell us through the app, within 24 hours of the scheduled session time, that the session did not take place or that something went wrong, the payment stays on hold while Speshul reviews it, and Speshul may then release it to the Professional, refund it to you, or divide it between you, based on that review. Speshul does not see or store your full card details, UPI PIN or net-banking credentials; payments are also subject to the terms of our payment partner.
6. Cancellations and Refunds
You may cancel or reschedule a booked session as follows: you may cancel or reschedule free of charge up to 24 hours before the session start time and receive a full refund; cancellations within 24 hours of the start time are non-refundable, because the Professional has reserved that time for you. If a Professional cancels or does not show up, you are entitled to a full refund or, if you prefer, to rebook with the same or another Professional. Please report a Professional no-show through the app within 24 hours of the scheduled session time (see Section 5). Refunds, where due, are processed to your original payment method within 3-5 business days.
7. No Guarantee of Outcomes; Not Diagnosis or Emergency Care
Speshul does not guarantee any specific educational, therapeutic, developmental, or assessment outcome from any session or Professional.
Speshul is not a medical, clinical or diagnostic service and does not itself diagnose, assess or treat any condition. Any assessment, report, opinion or recommendation you receive is the Professional's own, given in their independent professional capacity; Speshul does not review or endorse it. Information on the platform, including search results, is general guidance only and does not replace an evaluation by a qualified professional. Speshul is not for emergencies: if your child is at risk of harm or needs urgent medical help, call 112 or go to the nearest hospital.
8. Your Conduct
You agree to provide accurate information about your child's needs, treat Professionals respectfully, and not use the platform for any unlawful purpose. Speshul may suspend or terminate your account for violation of these Terms.
Your child's safety during sessions. For in-person sessions, you or another adult you have authorised must stay on the premises for the whole session. For online sessions, you or another adult you have authorised must be at home and reachable for the whole session. For minor children, an adult must stay on the premises You must not record a session without the Professional's consent. Please report any safety concern to Speshul immediately at support@speshul.in.
9. Reviews
Reviews you post must reflect your genuine experience. Speshul may remove reviews that are fraudulent, abusive, or that violate these Terms, but does not edit reviews on a Professional's behalf.
10. Relationship With Professionals
Professionals are independent third parties, not employees, agents, or representatives of Speshul. Speshul is not responsible for the acts, omissions, advice, or conduct of any Professional, though Speshul will investigate credible safety or conduct complaints reported to it and may suspend a Professional pending investigation.
Speshul is a discovery and booking platform, not an accrediting or supervisory authority. We do not evaluate, dictate, or take responsibility for a Professional's specific teaching methodology, therapeutic approach, personal work style, or compatibility with your child's individual needs, temperament, or learning style. Assessing fit is your responsibility, and you are free to end an engagement and book a different Professional at any time.
Misrepresentation. Speshul relies on the information and documents Professionals and other users give it and is not responsible for any false or misleading information they provide. If Speshul finds that a Professional has given false, expired or misleading credentials or information, Speshul may, without prior notice: remove the Professional's Verified badge and listing; suspend or close their account; cancel their upcoming bookings and refund you for sessions not yet delivered; inform you and other families who booked that Professional, to the extent needed to protect your child and your bookings; and report the matter to the relevant professional body or the authorities. Speshul reserves the right to take civil and criminal action against any user who provides false information and to claim damages.
11. No Circumvention of the Platform
To keep the platform sustainable for everyone, you agree not to directly or indirectly engage, hire, or pay a Professional you discovered or first contacted through Speshul, for the same or similar services, outside the platform, for a period of 12 months from your last interaction with that Professional on Speshul.
Sessions arranged outside Speshul. A session you arrange directly with a Professional outside the platform, even one you found on Speshul, is not a Speshul booking. Speshul has no role in it and no responsibility for it: the Verified badge, payment hold, refunds, cancellation terms, no-show review, grievance handling and safety follow-up in these Terms do not apply, and any dispute is between you and the Professional alone. If Speshul finds that bookings have been moved off the platform in breach of this Section, it may suspend or close the accounts involved.
12. Limitation of Liability
To the maximum extent permitted by law, Speshul's total liability to you arising from your use of the platform is limited to the amount of fees you paid through the platform in the 3 months preceding the claim. Speshul is not liable for indirect, incidental, or consequential damages.
13. Indemnification
You agree to indemnify Speshul against claims, losses, or damages arising from your breach of these Terms or misuse of the platform.
14. Grievance Redressal
If you have a complaint, contact our Grievance Officer: Chhavi Goyal at chhavi@speshul.in. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days, as required under applicable Indian consumer-protection rules for online platforms.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after an update constitutes acceptance of the revised Terms. Material changes will be notified to you in advance where required by law.
16. Governing Law
These Terms are governed by the laws of India, and courts at Bengaluru, Karnataka shall have exclusive jurisdiction. In case of any false, incorrect information furnished by the user including professional, the Speshul shall not be held responsible for such misrepresentation/false information rendered by the users and Speshul reserves its right to prosecute them both under Civil and criminal law and claim suitable damages.
